Además de esto, los miembros de organizaciones terroristas o sus afiliados; individuos involucrados en el patrocinio del terrorismo o cualquier otra actividad prohibida; individuos, incluidos en cualquier lista de sanciones y/o otras listas de vigilancia aprobadas por organizaciones internacionales, uniones de Estados, funcionarios públicos o sus familiares cercanos; personas que participen en sobornos o sobornos comerciales; no son elegibles para participar en esta Campaña (las “Personas Inhabilitadas”)

Si algún ganador rechaza el premio o se descubre con posterioridad a la entrega del premio que dicho ganador no ha cumplido con los Términos y Condiciones, o que ha actuado de forma fraudulenta o cometiendo algún ilícito para resultar ganador de la Campaña promocional; entonces dicho participante dejará de tener el carácter de ganador y deberá devolver el premio a petición de inDrive.

1. Para garantizar la transparencia, prevenir el abuso y proteger la integridad de la competencia promocional, el Promotor se reserva el derecho de descalificar participantes y ejercer acciones legales en los siguientes casos: 1. Contenido Falso – cualquier intento de enviar contenido falsificado, copiado, generado por inteligencia artificial o editado de manera sustancial (incluyendo imágenes, videos, capturas de pantalla o comentarios falsos) resultará en descalificación inmediata. El Promotor se reserva el derecho de solicitar archivos originales (metadatos, EXIF, grabaciones de pantalla) para verificar la autenticidad. 2. Viajes Falsos – cualquier viaje organizado en coordinación con otros usuarios (p. ej., entre amigos o conocidos), cancelaciones y reprogramaciones reiteradas, u otra actividad destinada exclusivamente a cumplir los requisitos de la competencia promocional sin prestación legítima del servicio. 3. Uso de Múltiples Cuentas – cualquier intento del usuario de crear o utilizar varias cuentas de inDrive para obtener una ventaja injusta o eludir las reglas de la competencia promocional. Si se detectan dichos vínculos, todas las cuentas relacionadas podrán ser descalificadas a discreción del Promotor. 4. Manipulación de Ubicación – cualquier alteración de datos GPS, incluyendo el uso de emuladores, rutas falsas o patrones de inactividad destinados a engañar a la plataforma. 5. Software No Autorizado – el uso de bots, scripts, aplicaciones de terceros o emuladores que simulen la actividad del usuario o influyan en el rendimiento bajo la plataforma y la experiencia del usuario. 1. Esta lista no es exhaustiva. El Promotor podrá ampliar o actualizar la lista de comportamientos fraudulentos a su exclusiva discreción, sin previo aviso, para hacer frente a riesgos recién identificados. 2. El Promotor se reserva el derecho de aplicar herramientas de detección automática o manual para identificar actividad irregular, incluyendo participaciones repetidas, respuestas idénticas, envíos de medios duplicados o patrones de interacción anormales (p. ej., aumentos repentinos en "me gusta", visualizaciones o comentarios provenientes de fuentes cuestionables). 3. Todos los Ganadores seleccionados deberán someterse a un proceso de verificación adicional, que incluye: a. Confirmación de Identidad – proporcionar nombre completo, fecha de nacimiento, país de ciudadanía y prueba de identidad válida (como licencia de conducción, matrícula del vehículo y seguro) según se requiera para cumplir con los criterios de elegibilidad de la competencia promocional. b. Verificación de Viajes – confirmar la autenticidad y legitimidad de los viajes completados durante el período de la competencia. 4. El Promotor se reserva el derecho de: a. Realizar auditorías de la actividad en la cuenta de cualquier participante, registros de viajes y documentación de distribución de incentivos. b. Suspender o cancelar cualquier recompensa si se detecta comportamiento sospechoso durante la revisión. c. Retrasar la distribución de incentivos mientras dure la investigación si se sospecha fraude. d. Descalificar a cualquier usuario que haya manipulado o intentado eludir las reglas de la competencia promocional, sin previo aviso. 1. Si se detecta fraude o infracciones de las reglas después de que se haya anunciado un Ganador, el Promotor se reserva el derecho de revocar el premio, reasignarlo a otro participante elegible y tomar las acciones legales o administrativas necesarias. 2. La conducta fraudulenta se considerará un incumplimiento material de estos Términos y Condiciones y podrá resultar en la exclusión permanente de futuras competencias promocionales. | 1. Fake Content – any attempt to submit falsified, copied, AI-generated or heavily edited content (including images, videos, screenshots, or fake comments) will result in immediate disqualification. Fake Trips – any trips arranged in coordination with users (e.g., between friends or acquaintances), repeated cancellations and rebookings, or other activity intended solely to meet promotional competition requirements without legitimate service delivery. 3. Multi-Accounting – any user attempt to create or use multiple inDrive accounts to gain an unfair advantage or bypass the promotional competition rules. If such links are discovered, all related accounts may be disqualified at the Promoter's discretion. 4. Location Manipulation – any tampering with GPS data, including the use of emulators, false routes, or idling patterns intended to deceive the platform. 5. Unauthorized Software – the use of bots, scripts, third-party apps, or emulators that simulate user activity or influence performance under the platform and user experience. 1. This list is non-exhaustive. The Promoter may expand or update the list of fraudulent behaviors at its sole discretion, without prior notice, to address newly identified risks. 2. The Promoter reserves the right to apply automated or manual detection tools to identify irregular activity, including repeated entries, identical answers, duplicate media submissions, or abnormal engagement patterns (e.g., sudden spikes in likes, views, or comments from questionable sources). 3. All selected Winners must undergo an additional verification process, which includes: a. Identity Confirmation – providing full name, date of birth, country of citizenship, and valid proof of identity (such as driver's license, vehicle registration, and insurance) as required to meet the eligibility criteria of the promotional competition. b. Trip Verification – confirming the authenticity and legitimacy of completed trips during the competition period. 4. The Promoter reserves the right to: a. Conduct audits of any participant's account activity, trip records, and incentive distribution documentation. b. Suspend or cancel any reward if suspicious behavior is detected during the review. c. Delay the distribution of incentives pending investigation if fraud is suspected. d. Disqualify any user found to have manipulated or attempted to bypass promotional competition rules, without further notice. 1. If fraud or rule violations are detected after a Winner has been announced, the Promoter reserves the right to revoke the prize, reallocate it to another eligible participant, and take any necessary legal or administrative action. 2. Fraudulent conduct will be treated as a material breach of these Terms and Conditions and may result in permanent exclusion from future promotional competitions. |
