1.2. The organization and administration of the Program may be carried out by one or more external service providers or partners that are not the Organizer (hereinafter referred to as the “Service Providers”).
1.3. These Terms and Conditions govern participation in the Program, use of digital platforms, and performance of related activities.
1.4. The objective of the Program is to provide women in the Federal Democratic Republic of Nepal with greater opportunities to achieve economic independence and personal development through: (i) training and driving courses; (ii) providing comprehensive assistance in obtaining a driver’s license; and (iii) providing support in registering as independent drivers in the inDrive mobile application. The specified activities may be carried out either directly by the Organizer or by Service Providers.
1.5. The Organizer reserves the right to change, amend, adjust, postpone, suspend, or cancel the Program, including these Terms and Conditions, the awarding of any prizes, or any other aspect of the Program at any time and for any reason. However, advance notice of any material changes will be provided via the Program website and/or to the email address provided by the Participant. Such changes shall not affect rights that have already arisen or privileges that have already been confirmed, except in cases of force majeure or receipt of orders from competent government authorities.
1.6. By providing their data on the website or applying to participate in the Program, users confirm that they have fully read, understood, and agree to these Terms and Conditions of Use, the Privacy Policy, and any other documents related to the Program.
1.8. All terms used in these Terms and Conditions of Use that are not expressly defined herein shall have the meanings assigned to them in the Privacy Policy or any other document governing the relationship between inDrive and its drivers, passengers, or Program participants. These terms form an integral part of these Terms and Conditions of Use, establishing the unified legal framework governing inDrive’s relationship with you. In the event of any conflict between the documents, this document shall prevail with respect to the Program.
1.9. This Program does not constitute a lottery, gambling, or betting.
1.10. inDrive is not responsible for the actions, negotiations, or agreements reached between Participants and Service Providers. inDrive’s responsibilities are limited solely to facilitating connections between Participants interested in the Program and funding their participation in Program-related events. The Organizer reserves the right to close registration early due to the quota of places being filled or for operational reasons, by posting a corresponding notice through the same communication channels.
2. DEFINITIONS
2.1. The Program is an inDrive program called “The Driving Naari” aimed at providing women in the Federal Democratic Republic of Nepal with opportunities to achieve economic independence and personal development.
2.2. Participant is any woman of legal age who registers for the Program and is its beneficiary.
2.3. Registration is the registration process carried out by participants on the Program website.
2.4. Privileges are training and driving courses, assistance in obtaining a driver’s license, and/or other support described herein and provided to selected Participants.
3. OBJECTIVE AND CONDITIONS OF PARTICIPATION IN THE PROGRAM
3.1. The specified activities may be carried out either directly by the Organizer or by Service Providers (hereinafter referred to as “Privileges”).
3.2. Participation in the Program is free, voluntary, and informed. Registration is merely an application to participate and does not automatically constitute acceptance into the Program, nor does it guarantee the selection of a candidate or the provision of any Privileges. Participant status is acquired only after the candidate has been selected in accordance with the Organizer’s criteria.
3.3. To apply for participation in the Program, a candidate must meet the following requirements:
a) be female;
b) be of legal age (18 years of age or older);
c) hold a national identity card and/or identity document of the Federal Democratic Republic of Nepal;
d) permanently reside in the city of Kathmandu (or additional cities, the list of which may be posted by the Organizer on the official Program website);
e) accept these Terms and Conditions of Use and the Privacy Policy.
3.4. When registering, candidates are required to provide accurate information. The Organizer has the right to request supporting documents and/or conduct a reasonable verification of the candidate’s identity and compliance with the established requirements.
3.5. Persons who meet the selection conditions may be included in the Program based on a review conducted by the Organizer and taking into account the following criteria:
i. registration number; ii. information submission or verification number; iii. receipt of legal documents; iv. life circumstances requiring priority attention (e.g., single mothers, economically vulnerable persons, etc.); v. motivation and overall quality of the application, as determined on the basis of the registration form and/or any interviews or checks that the Organizer deems necessary.
The adoption of positive support measures in favor of vulnerable groups remains at the discretion of the Organizer and is carried out in accordance with the objectives of the Program. Selection into the Program does not guarantee the provision of all Privileges and is dependent on the quota of places, operational capabilities, and the Participant’s continued compliance with the established requirements. The Organizer strives to ensure that the said criteria are applied objectively, transparently, and without discrimination.
3.6. Once the candidate’s compliance with the selection criteria is confirmed and she is approved in accordance with the Organizer’s internal criteria, such person acquires the status of Participant.
3.7 The Organizer reserves the right to restrict participation in the Program or access to its Privileges for candidates who have provided false information, do not meet the selection or vulnerability criteria, or violate these Terms and Conditions of Use.
3.8. Each Participant agrees to accept the services or Privileges from the Organizer on an “as is” basis, acknowledging and understanding all possible risks. The provision of independent services by the Participant through the inDrive platform does not give rise to any labor relations between the Participant and inDrive, as inDrive is a platform that connects independent service providers and clients without being directly involved in the agreements concluded between them. Nothing contained herein shall create any employment, subordination, or agency relationship between inDrive and the Participant.
3.9. Each Program Participant is fully responsible for fulfilling her tax obligations in accordance with the laws and regulations applicable in her jurisdiction. The Organizer assumes no obligation to withhold or pay taxes on behalf of any person on any potential income that may arise from participation in this Program. Any tax obligations, filing of tax returns, or payment of taxes is the sole responsibility of the taxpayer.
3.10. Each Participant is solely responsible for obtaining the necessary tax advice in a timely manner to ensure compliance with all relevant tax regulations and the proper fulfillment of her taxpayer obligations.
3.11. By accepting the Privileges, Participants confirm that they are in full compliance with the applicable anti-corruption laws of the Federal Democratic Republic of Nepal. They also confirm that they have not engaged in commercial bribery, bribery, fraud, or any other unlawful activity, and are not associated with or included in any sanctions lists or lists of persons under surveillance in connection with unlawful conduct.
3.12. Participants agree that the provision of Privileges may be subject to the completion of an identity verification procedure to confirm that they are not included on lists of persons subject to sanctions, persons involved in terrorist financing, or the laundering of proceeds from crime. This verification is always carried out in accordance with personal data protection legislation and in compliance with the principle of proportionality.
3.13. Financial coverage of training costs. The Program provides full (100%) coverage of the costs of driving training and the medical examination required to obtain a driver’s license for all participants who pass the selection process and receive beneficiary status.
The final assignment of beneficiary status is determined solely by the Organizer in accordance with pre-approved objective selection criteria. Such criteria may include, but are not limited to: (i) registration number; (ii) timeliness and accuracy of the information provided; (iii) acceptance and confirmation of legal documents; (iv) life circumstances requiring priority consideration; and (v) motivation and quality of the application, as determined on the basis of the registration form and/or the results of interviews or other checks conducted by the Organizer.
A mandatory condition for receiving financial support is the successful completion of the medical examination required to obtain a driver’s license. If the candidate fails the specified medical examination, financial support will not be provided and participation in the Program will be terminated.
The number of places in the Program is limited by established quotas and the operational capabilities of the Organizer. Submitting an application and completing registration does not guarantee admission to the Program or receipt of financial coverage.
4. PROCEDURE FOR USING PRIVILEGES
4.1. The Participant undertakes to indemnify and hold harmless the Organizer and its Service Providers from any claims by third parties arising from the actions or omissions of the Participant during the implementation of the Program. The above obligation does not apply to claims arising from willful misconduct (dolo) or gross negligence (culpa inexcusable) on the part of the Organizer or the Service Providers.

Costs assumed by inDrive for Participants receiving Privileges do not include the cost of materials or additional equipment that may be required to complete the course, such as books, study guides, subscriptions, additional courses or modules beyond those subsidized by inDrive, helmets, gloves, protective equipment, transportation costs, accommodation, etc., unless otherwise expressly stated in an official announcement.
4.8.Driver’s license: Obtaining a driver’s license is dependent on fulfilling the statutory requirements and successfully passing examinations at the competent authorities. The Organizer does not guarantee successful completion of the tests or the issuance of a driver’s license. Participants are required to undergo the official procedure (medical examination, traffic rules test, practical driving test, etc.).
